District court's denial of motion to withdraw nolo contendere plea was not an abuse of discretion, as counsel's performance did not satisfy fair and just reason requirement, defendant failed to demonstrate how the search of the vehicle violated his Fourth Amendment rights, defendant admitted his guilt and delayed in seeking withdrawal. Defendant waived Fourth Amendment claim. District court did not err in denying sentencing credit.
