U.S. Court of Appeals Case No: 06-2626
U.S. District Court for the Eastern District of Arkansas - Little Rock
[PUBLISHED] [Colloton, Author, with Gruender, Circuit Judge and
Goldberg, Judge of the Court of International Trade]
Civil case - employment law. For the court's first opinion in the matter, see Maxfield v. Cintas Corp., No. 2, 427 F.3d 544 (8th Cir. 2005). District court erred in granting summary judgment for the employer on plaintiff's claims under the Uniform Services Employment and Reemployment Rights Act; defendant presented essentially the same evidence and the same arguments in support of the summary judgment that this court rejected in the first appeal in the case, and the law of the case compels the decision that defendant was not entitled to summary judgment. Judge Gruender, dissenting.
