Civil Case - International Trade. The Eighth Circuit adopts the
"conservative" approach used in the First, Second, Third, Sixth and DC
Circuits for determining whether a foreign antisuit injunction should be
issued; applying that standard here, the antisuit injunction the district
court issued to prevent TKS from filing a suit under the Japanese Special
Measures Law, a clawback statute allowing Japanese nationals to sue to
recover any judgment entered against them under the Antidumping Act of
1916, must be vacated.
