Criminal case - criminal law. District court did not err in calculating the
amount of the government's loss in prosecution for conspiracy to
fraudulently obtain federal housing subsidies in violation of 18 U.S.C.
Secs. 371 and 641; government's actual loss in this type of case is the
amount of subsidies paid minus the amount HUD would have paid had
the defendants timely and truthfully disclosed the relevant circumstances;
here, the evidence confirms no subsidies would have been paid, and the
defendants were properly assessed the aggregate subsidies received
during the period of conspiracy.
