U.S. Court of Appeals Case No: 06-2674
U.S. District Court for the Southern District of Iowa - Des Moines

Judges]
Civil Case - ERISA. The federal common law of rights and obligations
under ERISA-regulated plans does not provide a right of contribution for
an ERISA fiduciary found liable for violating its obligations under the
statute against another fiduciary bearing some responsibility. ERISA is a
comprehensive statute provides strong evidence that Congress did not
intend to authorize remedies not set forth in the statute. State common-
law claims are also preempted by ERISA. Claims arose from breaches of
fiduciary duties by a fiduciary in an ERISA-regulated plan and
interpretation of plan is essential to the state law claims.
