U.S. Court of Appeals Case No: 06-2699
U.S. District Court for the Eastern District of Arkansas - Little Rock
[PUBLISHED] [Benton, Author, with Murphy and Shepherd, Circuit
Judges]
Criminal case - criminal law and sentencing. The district court did not
abuse its discretion in failing, sua sponte, to grant a continuance in the
case; district court did not err in calculating defendant's offense level;
district court did not err in imposing enhancements for a leadership role
in the offense, use of a minor, theft of documents by a co-conspirator, and
attempted murder of a witness; because the government failed to file
notice of prior convictions under 18 U.S.C. Sec. 3559, the court erred in
imposing a life sentence on those three counts; however, the error was
harmless, as defendant was properly sentenced to life on four other
counts, and all of the life sentences were run concurrently; no error in
imposing a $100,000 fine.
