U.S. Court of Appeals Case No: 06-2732
U.S. District Court for the Southern District of Iowa - Des Moines
[PUBLISHED] [Bye, Author, with Loken, Chief Judge, and Shepherd,
Circuit Judge]
Civil case - Employment Discrimination. Plaintiff failed to establish
adverse employment action and did not make a prima facie case of race
discrimination; claim that plaintiff suffered an adverse action because he
was constructively discharged from his position was not supported by the
evidence which showed that plaintiff quit his employment; claim of
hostile work environment was not supported by evidence showing
objectively hostile conduct; claim of retaliation failed as plaintiff was
not constructively discharged and the company's failure to stop minor or
trivial misconduct or comments was not sufficient to establish retaliation.
