U.S. Court of Appeals Case No: 06-2760
U.S. District Court for the Southern District of Iowa - Des Moines
[PUBLISHED] [Gruender, Author, with Colloton and Bright, Circuit
Judges]
Civil case - Employment Discrimination. Evidence was sufficient to
support the jury's finding that plaintiff was actually disabled, as
well as its decision to reject defendant's proffered reason for not
hiring plaintiff and to find that defendant discriminated against him
based on his disability; reasonable jury could have found that
defendant's offered explanation for not hiring plaintiff was a pretext
for age discrimination; evidence was sufficient to support an award
of punitive damages under the Americans with Disability Act; award
of emotional distress damages affirmed; award of liquidated damages
affirmed; award of front pay affirmed.
