U.S. Court of Appeals Case No: 06-2802
U.S. District Court for the Eastern District of Arkansas - Little Rock
[PUBLISHED] [Melloy, Author, with Wollman and Beam, Circuit Judges]
Criminal case - criminal law and sentencing. District court did not err in crediting police officers' testimony and finding defendant's post- Miranda statements were voluntary and admissible; evidence was sufficient to support convictions for possession of crack with intent to distribute for possession of a firearm while trafficking, and for being a felon in possession of a firearm; felon in possession count and crack cocaine count should have been grouped for sentencing purposes, and the case is remanded for resentencing.
