U.S. Court of Appeals Case No: 06-2805
U.S. District Court for the Western District of Arkansas - Fayetteville
[PUBLISHED] [Wollman, Author, with Beam and Riley, Circuit
Judges]
Criminal Case - sentence. Lifelong term of supervised release with
special condition that defendant not have Internet access at his residence
was not plain error based on guilty plea to receiving and attempting to
receive child pornography, as defendant's admissions provided nexus
between use of the internet and his exploitation of minor. Enhancement
under 2G2.2(b)(5) based on a finding of a pattern of sexual abuse and
exploitation of a minor was not clear error. Hearsay statements were
corroborated by defendant's admission.
