U.S. Court of Appeals Case No: 06-2854
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Bright, Author, with Colloton and Gruender, Circuit Judges]
Civil case - ERISA. In order to recover under ERISA for a faulty Summary Plan Description, the claimant must show he was prejudiced by the error; the district court erred in adopting a standard which permitted recovery if the claimant was likely to have been harmed by the error; instead, an employee must show he relied on the terms of the faulty Summary Plan Description to his detriment; here, claimant failed to make any showing of detrimental reliance and the district court erred in granting him summary judgment. Judge Gruender, concurring.
