U.S. Court of Appeals Case No: 06-2875
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Smith, Author, with O'Connor, Associate Justice
(Ret.) and Wollman, Circuit Judge]
Criminal case - Sentencing. Whether defendant's sentence was viewed
as a 100% or 77% variance from the applicable Guidelines range, it was
atypical and greater than the court has deemed reasonable; while the
district court recited the factors set out in Sec. 3553(a), it failed to
give appropriate weight to the seriousness of the offense, the need to
promote respect for the drug laws, the importance of ensuring deterrence,
and the need to avoid unwarranted sentencing disparities; case remanded
for resentencing.
