Prisoner case - habeas. District court did not err in affirming Bureau of Prisons finding that the Bureau had no facts in the record from which it could reasonably determine any expression by the sentencing judge that Fegans' federal sentence should run concurrent with any yet-to-be- imposed state sentence; having determined that there was no evidence that the sentencing federal court intended concurrent sentences, the Bureau did not err in applying Program Statement 5160.03 in deciding it was not in the interest of he criminal justice system to grant a nunc pro tunc designation.
