U.S. Court of Appeals Case No: 06-3002
and No: 06-4127
Board of Immigration Appeals
[PUBLISHED] [Loken, Author, with Gruender and Benton, Circuit Judges]
Petition for review - Immigration. Court lacked jurisdiction to review
ruling that petitioner's asylum application was untimely; with respect
to claim for withholding for removal, the Immigration Judge's finding
that petitioner's testimony was not credible was entitled to deference
as it was supported by specific, cogent reasons for disbelief; BIA did
not abuse its discretion in denying petitioner's motion to reconsider;
petitioner was subject to the restrictions on asylum-only proceedings
set forth in 8 C.F.R. Sec. 1208.2(c)(3)(i); as the IJ did not have
jurisdiction to consider an adjustment of status in this asylum-only
proceeding, the BIA did not abuse its discretion in denying petitioner's
motion to reopen the proceedings for that purpose.
