U.S. Court of Appeals Case No: 06-3032
U.S. District Court for the Southern District of Iowa - Des Moines
[PUBLISHED] [Wollman, Author, with Melloy, Circuit Judge, and
Nangle, District Judge]
Criminal case - Criminal law and Sentencing. Waiver of right to
counsel at trial was knowingly and intelligently given; defendant's
statement during search of his home was properly admitted as showing
consciousness of guilt; court did not abuse its discretion in referring the
jury to the instructions already given when the jury asked for a
supplemental instruction on possession; evidence was sufficient to
support a conviction for being a felon in possession of a firearm; court
erred in imposing an obstruction of justice enhancement based for perjury
as the record does not establish that the court exercised its independent
judgment in reaching the decision to impose the enhancement.
