Civil case - Civil rights. Plaintiff police officers have alleged
sufficient facts to show that the defendant sheriff caused them to
suffer material changes in their employment that rose to the level
of adverse employment actions in retaliation for their exercise of
their First Amendment rights, and the district court did not err in
denying the defendant's motion for summary judgment based on qualified
immunity; defendant O'Hara was entitled to qualified immunity because
the law was not clearly established that the actions he took with
respect to plaintiff Moore had employment consequences serious enough
to amount to adverse employment actions; court had no jurisdiction
to address the county's immunity defense in this interlocutory appeal.
