Civil case - Abortion. An elective, non-therapeutic abortion does not
constitute a serious medical need, and the Missouri Department of
Corrections policy refusing to provide inmates with transportation for
such abortions does not rise to the level of deliberate indifference
required to constitute an Eighth Amendment violation; however, the
policy does violate prisoners' Fourteenth Amendment rights under the
test for reviewing the reasonableness of prisoner regulations impacting
constitutional rights established in Turner v. Safely, 482 U.S. 78 (1987),
and the district court order enjoining enforcement of the policy is
affirmed.
