Civil case - Torts. Interpreting Missouri precedents, the court
concludes that the Missouri Supreme Court would recognize medically
documented damages need not be proven in order a plaintiff to establish
the tort of intentional infliction of emotional distress, and the district
court erred in granting defendant's motion for summary judgment on the
ground that plaintiff had failed to support her claim with expert medical
testimony; district court also erred in finding the claim was preempted by
federal labor law.
