Civil case - Medicaid. Medicaid Services' request for additional
information regarding state's request for an increase in the annual
Supplemental Medical Assistant payments made by the federal Medicaid
program to county-owned nursing homes was not a new substantive rule
subject to notice and comment requirements; increased scrutiny of the
plan amendment, including the request for additional information, was
consistent with the Secretary's authority in an individual adjudication;
denial of the amendment was not arbitrary, capricious, an abuse of
discretion, unsupported by substantial evidence or contrary to law.
