U.S. Court of Appeals Case No: 06-3324
District of North Dakota - Bismarck
[PUBLISHED] [Smith, Author, with Chief Judge Loken and Gruender,
Circuit Judges]
Criminal Case - suppression. Even if testimony of two officers
at a hearing to support basis for searching two continguous
properties failed to provide a sufficient nexus between both
properties and the illegal activity being investigated, the
officers were not entirely unreasonable in believing the warrant
was supported by probable cause under the totality of the
circumstances. District court's denial of motion to suppress is
affirmed.
