Civil case - arbitration. Where the parties' arbitration agreement permits the parties to select interested arbitrators, evident partiality cannot serve as a basis for vacating an award under 9 U.S.C. Sec. 10(a)(2), absent a showing of prejudice; here, defendant failed to show that the challenged arbitrator's partiality had a prejudicial impact on the arbitration award, and the district court did not err in affirming it.
