U.S. Court of Appeals Case No: 06-3369
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Loken, Author, with John R. Gibson and Wollman,
Circuit Judges]
Criminal case - criminal law. District court did not err in finding
defendant was under supervision at the time he committed new offenses;
one-year term of supervised release was tolled when defendant began
serving an eight-year state sentence and it had not expired when federal
authorities issued a warrant or when the court issued its revocation order;
Speedy Trial Act does not apply to supervised release revocation
proceedings as they are not stages of a criminal prosecution.
