U.S. Court of Appeals Case No: 06-3384
U.S. District Court for the Southern District of Iowa - Des Moines
[PUBLISHED] [Loken, Author, with Wollman and Riley, Circuit
Judges]
Prisoner case - habeas. Where counsel did not hear his client's
directive to file an appeal at the sentencing proceedings, counsel was not
ineffective in failing to file an appeal; while the better practice is to
consult a client about the possibility of an appeal, under the
circumstances - a guilty plea, a sentence within the range bargained for
and waiver of some appeal rights - counsel was not ineffective in failing
to follow up and consult about the filing of an appeal.
