U.S. Court of Appeals Case No: 06-3404
U.S. Bankruptcy Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Murphy, Author, with Benton and Shepherd, Circuit
Judges]
Bankruptcy - turnover. Bankruptcy Appellate Panel's decision reversing
bankruptcy court's order for debtor to return to estate money in bank
account that had not processed as of the date of bankruptcy filing is
affirmed. Funds transferred by the checks are property of the estate and
debtor did not have control of money after they were honored; thus debtor
cannot be subject of motion to compel turnover. Trustee is one
authorized to avoid prepetition transfers.
