U.S. Court of Appeals Case No: 06-3433
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Benton, Author, with Murphy and Bright, Circuit Judges]
Civil case - Civil rights. Police officials were entitled to qualified
immunity on the plaintiff's claims that they had been discriminated
against on the basis of their gender; while defendants discriminated
against plaintiffs on the basis of their gender when they assigned
them to night shift work, and while the decision to do so was not
supported by an important government objective, reasonable police
administrators could believe that the decision to assign female
officers to the night watch to assure that female officers were
available for certain police functions was lawful and did not deprive
plaintiffs of any constitutional rights.
