U.S. Court of Appeals Case No: 06-3510
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Benton, Author, with John R. Gibson and Wollman,
Circuit Judges]
Civil case - Contracts. Complaint alleging the defendant violated the
Minnesota Human Rights Act when it terminated plaintiff's contract in
retaliation for complaining about sexual harassment of one of its drivers
was time barred because the suit was not brought within one year of the
discriminatory act; breach of contract claim was properly dismissed, as
defendant's employee's statement that she would investigate and resolve
the complaint did not form a contract; nor did the statement provide a
basis for a claim of promissory estoppel since plaintiff could not show
detrimental reliance.
