U.S. Court of Appeals Case No: 06-3533
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Bowman, Author, with Benton and Shepherd, Circuit
Judges]
Criminal Case - suppression. No clear error in district court's credibility
findings. Interrogation of defendant after he answered the door was not
unlawful, as officers had an eviction notice to serve and question about
the length of time it took to answer the door did not violate the Fourth
Amendment. Defendant was asked to identify himself after he had been
arrested for possession. Evidence obtained are not fruits of unlawful
detention.
