U.S. Court of Appeals Case No: 06-3551
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Bye, Author, with Smith and Beam, Circuit Judges]
Civil case - employment discrimination. Plaintiff filed to establish a
prima facie case of retaliation as she did not show that she suffered a
materially adverse employment action in retaliation for her discrimination
complaint; plaintiff also failed to establish a hostile work environment
claim as she presented no evidence of workplace conduct which rises to
the level of actionable harassment; plaintiff failed to establish a prima
facie case of gender discrimination because she did not show that she had
suffered an adverse employment action; district court did not err in
rejecting plaintiff's argument that she was constructively discharged as
the conduct she pointed to was neither severe or pervasive enough to
support such a claim.
