U.S. Court of Appeals Case No: 06-3697
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Bowman, Author, with Bye and Smith, Circuit Judges]
Civil Case - age discrimination. Grant of summary judgment to employer
is affirmed. District court erred in requiring employee to show he met
the employer's legitimate expectations to make out his prima facie case,
when employee needed only to show he was "otherwise qualified." Error,
however, was not reversible, as employee did not demonstrate the
employer's reasons for terminating him unsatisfactory performance
was a pretext for illegal discrimination. Employee did not show a genuine
issue as to whether reasons were contrived or that the production targets
were a pretext.
