Immigration & Naturalization Service
[PUBLISHED] [Gruender, Author, with Colloton and Arnold, Circuit
Judges]
Petition for Review - Immigration. Immigration Judge's credibility
findings were supported by the record; even assuming the credibility
issues concerning petitioners' documents were set aside, the petitioners
failed to provide sufficient evidence that they had suffered from past
persecution based on their religious beliefs or that they had well-founded
fear of persecution if they returned to Uzbekistan; petitioners' claim that
they were entitled to asylum because the INS breached the confidentiality
of the proceedings rejected; claim for withholding of removal must be
rejected as petitioners failed to demonstrate a clear probability of
persecution.
