U.S. Court of Appeals Case No: 06-3802
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Riley, Author, with Bye and Bright, Circuit Judges]
Civil case - civil rights. In Section 1983 action claiming unlawful use of deadly force, defendants were entitled to qualified immunity as officers only used deadly force after plaintiff's decedent repeatedly stabbed one of the officers with a Samurai sword, and the decision to use deadly force to protect a fellow officer under attack was reasonable and justified; officers were also entitled to official immunity on plaintiff's Minnesota state law claims as their use of force was reasonable and could not be characterized as willful or malicious; further, the record established the officers' actions complied with the City's policy for dealing with mentally or emotionally disturbed persons.
