U.S. Court of Appeals Case No: 06-3883
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Arnold, Author, with Colloton and Gruender, Circuit
Judges]
Prisoner case - prisoner civil rights. In an action alleging defendants
failed to take action to protect him from attack by his cellmate, plaintiff
presented sufficient evidence of a substantial threat of violence, as well as
evidence that the defendant guards were deliberately indifferent to his
complaint, and the district court did not err in denying guards' motion
for summary judgment based on qualified immunity.
