U.S. Court of Appeals Case No: 06-3916
U.S. District Court for the Northern District of Iowa - Sioux City
[PUBLISHED][Riley, Author, with Wollman and Hansen, Circuit Judges]
Criminal Case - sentencing. Following remand for resentencing, district
court sentenced to two concurrent 68-month terms of imprisonment,
representing a 50% downward departure and 7-level downward
reduction. Case is remanded for resentencing because district court's
imposition of sentence below statutory minimum, although based only on
substantial assistance considerations, was nonetheless unreasonable
because extraordinary circumstances were not present.
