U.S. Court of Appeals Case No: 06-3950
U.S. District Court for the Northern District of Iowa - Cedar Rapids
[PUBLISHED] [Riley, Author, with Chief Judge Loken and Beam,
Circuit Judges]
Criminal Case - withdraw of guilty plea. District court did not abuse its
discretion in denying motion to withdraw guilty plea because, contrary to
defendant's assertion that no factual basis exists to establish guilt of
possessing a firearm, a sufficient factual basis exists to establish
constructive possession. Shotgun was found in getaway vehicle used by
defendant.
