U.S. Court of Appeals Case No: 06-3999
U.S. District Court for the Eastern District of Arkansas - Jonesboro
[PUBLISHED] [Murphy, Author, with Beam and Shepherd, Circuit
Judges]
Civil case - torts. Plaintiff waived any challenge to the court's ruling on
his motion in limine by mentioning the evidence in his opening
statement; in any event, admission of evidence that plaintiff had
consumed beer and that first responders smelled alcohol on his breath
was not plain error; jury verdict was consistent with the instructions and
the jury's decisions on the claims and counterclaims were not
inconsistent.
