Criminal Case - sentencing. Government appeals sentence of three years
probation for pseudoephedrine possession charges. Both defendants
qualified for safety valve relief and were granted a downward variance.
As to Shy, district court failed to discuss her possession of
methamphetamine at the time of her arrest and case is remanded for
resentencing to consider this conduct. Burton's sentence is affirmed, as
district court adequately explained justification for variance and is
substantively reasonable. Judge Colloton concurs.
