U.S. Court of Appeals Case No: 06-4038
U.S. District Court for the Southern District of Iowa - Des Moines
[PUBLISHED] (Chief Judge Loken, Author, with Arnold and Colloton,
Circuit Judges)
Civil Case - employment discrimination. Termination for falsely
reporting workplace injury does not constitute exercise of workers'
compensation rights in violation of state public policy and thus employee
failed to prove causation in retaliation claim. Employee's disability
discrimination claim was properly denied because employee failed to
prove he was disabled. Ability to do another job of same general class is
inconsistent with substantial limitation on major life activity of working.
