Civil case - Employment Discrimination. In suit alleging defendant
discriminated against plaintiff and failed to accommodate his Seventh
Day Adventist beliefs, the district court erred in instructing the jury that
a reasonable accommodation must eliminate the religious conflict;
however, this instruction was not reversible, as under the circumstances
presented in the case, the instruction did not mislead the jury or have a
probable effect on the verdict; award of compensatory damages and
restatement with front pay is affirmed; however, the injunctive relief
concerning future accommodations was overbroad and is vacated;
punitive damage award set aside as there was no evidence that any UPS
employee acted with malice or reckless indifference to plaintiff's
accommodation request; award of attorneys' fees and costs affirmed.
