In declaratory judgment action to clarify insurance company's obligation under insurance policies to defend entities in state court negligence action brought by resident's family in retirement home, district court did not err in denying family member right to intervene as a matter of right under Rule 24(a)(2) because contingent right of recovery is not cognizable or legally protectable and district court did not abuse its discretion in denying her permissive intervention.
