U.S. Court of Appeals Case No: 06-4097
and No: 07-1267
U.S. District Court for the Northern District of Iowa - Sioux City
[PUBLISHED] [Gruender, Author, with Loken, Chief Judge, and
Benton, Circuit Judge]
Criminal case - criminal law. District court erred in granting
defendants' motions for new trial on their convictions for conspiring to
impede justice, as the evidence in the case does not weigh so heavily
against the jury's finding that a miscarriage of justice would result if the
convictions were not set aside; district court did not err in refusing to
apply the sporting purposes or collection reduction of Guidelines Sec.
2K2.1(b)(2), as the evidence established defendant used the handgun in
question for personal protection.
