U.S. Court of Appeals Case No: 06-4157
and No: 07-1104
U. S. District Court for the Northern District of Iowa - Dubuque
[PUBLISHED] [Shepherd, Author, with Bye and Benton, Circuit Judges]
Criminal case - criminal law and sentencing. Search warrants were
supported by probable cause, and the district court did not err in denying
defendant's motion to suppress and her request for a Franks hearing;
officers had probable cause to search defendant's vehicle after a canine
sniff showed the presence of drugs in the car; search was also authorized
as a valid inventory search incident to impoundment; even if defendant's
co-conspirators' out-of-court statements were not properly admitted
under Bell, the error was harmless given the overwhelming weight of her
guilt; evidence was sufficient to support defendants' convictions; district
court's drug-quantity findings were not erroneous.
