Civil case - civil rights. School administrator's comment that whites
could teach black kids better than someone from their own race was
direct evidence that race was a motivating factor in the decision not
to hire plaintiff, and the district court erred in finding that
plaintiff had failed to adduce direct evidence of race discrimination;
plaintiff's other claims were subject to the McDonnell Douglas analysis
because they were only supported by circumstantial evidence; plaintiff's
claim that the district discriminated against her by failing to pay her
long term substitute pay is remanded for further proceedings; summary
judgment in district's favor on plaintiff's claim that she was excluded
from the substitute teacher list on the basis of her race is affirmed;
the district's summary judgment on the claim that it discriminated in
the frequency of her assignments is reversed; claim concerning district's
decision not to hire plaintiff for the position of home school coordinator
remanded for further proceedings; certain of plaintiff's retaliation
claims remanded.
