U.S. Court of Appeals Case No: 06-4171
U.S. District Court for the District of South Dakota
[PUBLISHED] [Colloton, Author, with Loken, Chief Judge, and
Arnold, Circuit Judge]
Criminal case - Criminal law. Evidence was sufficient to support
defendant's conviction for assault with a dangerous weapon and assault
by striking, beating or wounding; district court did not err in admitting
evidence that defendant also beat the victim six days after the incident in
question because the evidence was admitted to rehabilitate the victim's
credibility by having her describe the circumstances which prompted her
to report the earlier, charged assault.
