U.S. Court of Appeals Case No: 06-6062
U.S. Bankruptcy Court for the District of Nebraska
[PUBLISHED] [Schermer, Author, with Kressel, Chief Judge, and
Venters, Bankruptcy Judge]
Bankruptcy Appellate Panel. Plaintiff, which held an artisan's lien on
debtors' farm equipment by virtue of its repairs to the equipment, did not
lose its lien when debtor took the equipment without authority; as a
result, the artisan lien did not lose its priority over the defendant
lender's blanket lien. Chief Judge Kressel, dissenting.
