U.S. Court of Appeals Case No: 07-1045
District of North Dakota - Bismarck
[PUBLISHED] [Arnold, Author, with Loken, Chief Judge, and
Colloton, Circuit Judge]
Criminal case - Criminal law. While the court erred in excluding
testimony about prior inconsistent statements, the error was harmless;
defendant was given ample opportunity to show certain witnesses were
biased, and the district court did not err in refusing to allow him to show
they had been witnesses against his brother in an unsuccessful criminal
prosecution; no error in excluding hearsay statements; no error in
admitting evidence of defendant's blood alcohol concentration.
