and No: 07-1329
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Shepherd, Author, with Melloy and Bright, Circuit
Judges]
Criminal case - Sentencing. District court did not err in imposing an
enhancement for possession of a firearm in connection with defendants'
drug offenses; district court did not err in imposing a three-level
enhancement under Guidelines Sec. 3B1.1(b) for defendant Canania for
role in the offense; no error in denying Canania's request for a two-level
decrease for acceptance of responsibility; neither defendants' sentence
was unreasonable. Judge Bright, concurring, to express his view that the
consideration of acquitted conduct to enhance a defendant's sentence is
unconstitutional.
