U.S. Court of Appeals Case No: 07-1098
U.S. District Court for the Northern District of Iowa - Cedar Rapids
[PUBLISHED] [Wollman, Author, with Hansen and Riley, Circuit
Judges]
Criminal Case -sentencing. District court did not err in considering prior
incest convictions to enhance sentence for possession of child
pornography under 18 U.S.C. sec. 2252A(b)(2). Although element of
incest do not include victims who are minors or the use of force, district
court did not err in looking at underlying factual circumstances of prior
offense, of which defendant did not object to the accuracy of those factual
allegations, to determine that enhancement was appropriate.
