Standard Insurance Company U.S. Court of Appeals Case No: 07-1168 U.S. District Court for the Western District of Missouri - Kansas City [PUBLISHED] [Bye, Author, with Bowman and Smith, Circuit Judges]
Civil Case - . District court's grant of summary judgment to insurer who reduced death benefits based on a suicide exclusion is affirmed. Missouri statute barring suicide exclusion does not apply because policy was issued to a non-Missouri citizen in Idaho and group policy holder's residence, not individual certificate holder, applies. Insurer did not abuse its discretion in denying benefits under Plan 2 where policy was not in effect for the required 2 years.
