U.S. Court of Appeals Case No: 07-1298
U.S. District Court for the Northern District of Iowa, Waterloo
[PUBLISHED] [Murphy, Author, with Melloy and Colloton, Circuit Judges]
Criminal case - Criminal law and sentencing. Defendant's challenge to
the search warrant did not establish that the warrant application contained
intentional or reckless falsehoods or omissions, and the district court did
not err in denying his request for a Franks hearing; further, the application
was sufficient to establish probable cause for the issuance of a search
warrant even if the challenged information was excised; district court did
not err in sentencing defendant as career offender as his two burglaries of
commercial buildings qualified as crimes of violence for purposes of
Guidelines Sec. 4B1.1(a)(2).
