U.S. Court of Appeals Case No: 07-1337
U.S. District Court for the Southern District of Iowa - Davenport
[PUBLISHED] [Chief Judge Loken, Author, with Gruender and
Benton, Circuit Judges]
Criminal Case - suppression. District court's denial of motion to
suppress post-arrest statements made without Miranda warnings is
affirmed, as questioning fell within public safety exception to Miranda,
even though weapon had been found and defendant was handcuffed and
under control of officers, as officers had good reason to be concerned
about existence of additional weapons. Judge Gruender concurs.
